SCOPE OF AGREEMENT
Please read our Terms and Conditions (“the Terms”) carefully before booking classes. By booking a class or purchasing a package, at the end of this document you are confirming that you have read the Terms and agree to be bound by them. These Terms together with the items listed below, constitute a contract of membership between you (the client) and us (The Furm by Murf LLC). Please ensure that you read and understand our Policy Update further down before attending any class at the studio.
- STUDIO POLICIES, RULES, AND REGULATIONS
HEALTH & SAFETY:
I have been examined by a physician within the past year and have been found to be in good physical health and fully capable of performing all exercises that will be taught during all classes at The Furm, LLC conducted by any instructors or contractors of The Furm , LLC. If I have not been examined within one year then I have decided to participate in all activities at my own risk, assuming all responsibilities for my participation.
I am aware that participating in any physical exercise, sports activity or fitness programs can be dangerous and can involve risks or injuries. I am aware that temperatures may exceed 100 degrees Fahrenheit in some classes. I acknowledge that I am participating in these activities assuming all risks and dangers of injury from my actions or actions of others.
I accept all risks as stated herein and freely, voluntarily and expressly agree that at The Furm, LLC, their officers, members, directors, agents, employees, instructors, volunteers, independent contractors and those acting by and/or on behalf of at The Furm, LLC will not be liable (whether related to a fitness program or not) for any and all liability, claims or causes of action or demands of any kind or nature whatsoever that may result or arise, by or in connection with my participation in any activities related to the programs or classes offered by at The Furm, LLC. The scope of this document includes without limitation any personal, bodily, of mental injury, economic loss or damage to me, my spouse, guests, dependents, children or relatives resulting from any and all acts of negligence on the part of at The Furm, LLC. This release shall unequivocally release The Furm, LLC, its affiliates, officers, members, directors, agents, employees, instructors, volunteers, independent contractors and those acting by and/or on behalf of at The Furm, LLC, from all claims injuries and damages, present or future anticipated or unanticipated, resulting from or arising out of my use or intended use of the facilities or equipment.
I hereby certify that I am at least 18 years of age and have read the contents of this informed consent and release of liability (Parent or Guardian signature is required for participants under 16-17 years of age).
INJURY/PREGNANCY/POSTPARTUM/SENSITIVIES:
If recovering from injury or illness, are recently postpartum, or have known physical or sensory sensitivities, please notify the instructor prior to class start time.
Workout not suitable for pregnancy. Infrared heat raises your core body temperature slightly, which is great for general detox purposes but strongly not advised for expecting mothers. Please contact us if interested in non-heated private sessions.
CLASS CANCELLATIONS:
Classes may be canceled up to 12 hours prior to class start time. If you cancel within 12 hours, do not check in or do not show up for class, your pass will be deducted as if you have attended (for drop ins and class pack holders).
RETURNS AND REFUNDS:
All purchases for Services (Class Packs, Drop-Ins, Events, Workshops) are non-refundable, non-transferable, non-adjustable, and non-applicable to future purchases. Unattended classes or any unused services cannot be refunded. Our schedule and offerings are subject to change at any time and are not grounds for a refund. We encourage you to be modest in your initial purchases, and make sure you can reach the venue and enjoy our services and our instructors before making a larger purchases.
Unused merchandise will be accepted for a full refund within 7 days of purchase. No returns will be provided without a receipt.
WORKSHOP AND EVENT CANCELLATIONS:
Workshops and events are non-refundable from the time of booking
NON-RECORDING OF CLASSES AGREEMENT: You acknowledge and agree that any type of recording or transmission (video, audio, still photography, streaming, social media posting, etc.) of The Furm classes or activities is strictly prohibited without the prior written consent of an authorized corporate officer of The Furm . The Furm instructors are not authorized to provide consent.
You are, however, permitted to record and post lawful, non-offensive content related to your participation in The Furm class before and/or after a class with the consent of each participant who is identified in your content.
Any violation of this non-recording agreement is grounds for exclusion from participation in any of The Furm activities. You further agree to indemnify, defend, and hold harmless The Furm, its officers, directors, employees, agents, and instructors, from and against any claims, lawsuits or other actions, and all resulting loss, damage or cost of any kind (including reasonable attorneys’ fees), resulting from your violation of this non-recording agreement.
PERSONAL BELONGINGS:
You agree that we are in no way responsible for the safekeeping of your personal belongings while you are present in the studio. You assume all risk of loss for any of your personal belongings. - NON-HARASSMENT POLICY
The Furm disapproves of any un-welcomed, inappropriate and/or offensive conduct by its personnel or its members. If you believe you have been subject to un-welcomed, inappropriate, and/or offensive conduct by any of The Furm personnel, including while participating at The Furm studio, or any other activities related to The Furm, we encourage you to clearly and promptly tell the person engaging in the conduct that is un-welcomed and offensive (if you are comfortable doing so). When making a report or complaint, we strongly recommend that you provide as much specific information as possible in writing, including the following regarding each alleged incident: date, time, place (specify studio location or time/type of virtual class), names of any witnesses, what was said or done, and any other relevant surrounding facts/circumstances.
The Furm will strive to appropriately investigate any reported incidents and seek to provide due process for all parties. The Furm’s responsive actions, however, cannot be known in advance since they will vary depending upon the nature of the allegations. The Furm strives to maintain confidentiality throughout the investigative process to the extent practicable. However, our duty to investigate and take corrective action as appropriate may require the disclosure of certain information, and therefore confidentiality cannot be guaranteed. - INTELLECTUAL PROPERTY RIGHTS
The content on the Site and mobile apps, including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos interactive features and the like (“Content”) and the trademarks, service marks and logos contained therein (“Marks”), are owned by or licensed to The Furm, subject to copyright and other intellectual property rights under the law. Content on the website is provided to you as is for your information and personal use only and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners. We reserve all rights not expressly granted in and to the website and the content. You acknowledge and agree that any questions, comments, suggestions, ideas, feedback or other information about the website or services, provided by you to company are non-confidential and shall become the sole property of The Furm.
You agree to not engage in the use, copying, or distribution of any of the content other than expressly permitted herein. You agree not to circumvent, disable or otherwise interfere with security-related features of the website or features that prevent or restrict use or copying of any content or enforce limitations on use of the website or the content therein.
The Furm’s other graphics, logos, marks, and designs are trademarks of The Furm in the U.S. for which applications are pending. The Furm trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion and may not be copied, imitated, or used, in whole or in part, without the prior written permission of The Furm. - CHANGES TO THIS AGREEMENT
We reserve the right to modify the Terms at any time, in our sole discretion. If we modify material terms to these Terms, such modification will be effective after we send you notice of the amended agreement, if permitted under the applicable law. Such notice will be in our sole discretion, and the manner of the notification may include, for example, via email, posted notice on the Site or Apps, or other manner. Your failure to cease use of the Services after receiving notification of the modification will constitute your acceptance of the modified terms.
If you do not agree to any of these Terms or any changes to these Terms, please do not use, access or continue to access the Services, or discontinue any use of the Services immediately. - CONTACTING US
